USCIS has announced this morning on LinkedIn the key H-1B registration dates for the upcoming 2021 fiscal year H-1B Cap season, as follows:

February 18, 2020: Representatives may begin creating myUSCIS H-1B Registration Accounts.

February 14, 2020: Employers may begin creating myUSCIS H-1B Registration Accounts.

March 1, 2020: Registration opens.

March 20, 2020: Registration closes.

April 1, 2020: Filing begins for selected petitioners ONLY.

Under the new H-1B electronic registration process, employers or their authorized representatives must electronically submit a separate registration naming each alien for whom they seek to file an H-1B cap-subject petition. Although employers can register multiple aliens during a single online submission, duplicate registrations for the same beneficiary in the same fiscal year will be discarded. Employers with selected registrations will then be eligible to file a cap-subject petition starting April 1, 2020, only for the alien named in the registration selected by USCIS.

USCIS will provide overviews of the new H-1B electronic registration process this week and next week. Dykema will provide updated information on forthcoming guidance as soon as it becomes available.
