Identification, Prevention and Response: Workplace Violence and Active Shooter

Each year, for the last several years, approximately 2 million workers in the United States claim to have experienced a workplace violence incident. The type of violence ranges from aggressive verbal behavior to active shooters. One FBI study cited 160 active shooting incidents that occurred from 2000 to 2013 with 80% happening in the workplace. The majority of the shooters were not employed with the company where the acts took place.

Sadly, these destructive incidents may happen anywhere and the cost to individuals and the business is astronomical. This workshop will discuss ways to identify potential sources of violent behavior, how to possibly prevent the acts and responses to egregious acts in order to protect employees and mitigate the results. 

The legal complications in this area are complex. As such, this session will include a review of Texas laws regarding workplace violence and the liability they may impose upon employers. Additionally, the speakers will present judicial cases demonstrating fact patterns where employers were responsible for damages to employees caused by workplace violence and conversely where there was no responsibility. Finally, there will be material on the current legal status based on claims of negligent hiring, supervision and retention.

  • OSHA’s position on workplace violence
  • Sources of liability for employers when violence occurs
  • How does concealed and open carry affect workplace violence
  • What employment policies should be in place
  • How to use third party resources, such as Employee Assistance Programs
