Prohibited Workplace Harassment and Current Employment Law Trends

In January 2017, the EEOC released proposed guidance regarding workplace harassment. While the guidance is not yet effective, the current Acting Chair of the EEOC, Victoria Lipnic, was heavily involved in the drafting of the updated guidance thus it is believed much of the guidance will go into effect. 

Employers should start preparing now for the new guidance as many current anti-harassment policies may not extend as far as the EEOC deems necessary and, in some cases, the guidance is contrary to existing case law. The guidance also requires interactive training and, most alarmingly, the EEOC urges employers to conduct civility and bystander training! Finally, the concept of implicit bias, without more evidence of bias, is creeping more and more into lawsuits against employees. 

In this workshop, Dykema Cox Smith Member Daniel R. Stern will also cover actions the “new” administration may take related to potential enforcement policies, and possible legislation to help prepare you to handle employee matters related to wage and hour issues, EEOC reporting requirements, NLRB’s impact on social media, union organizing, whistleblowers, workplace investigations and more. Finally, the presentation will address recent cases impacting employers.

  • Potential impact based on the new leader of the Department of Labor, Alexander Acosta

  • Current definition of implicit bias and tips to  avoid bias in workplace decisions
  • Impact of gender roles, gender identity and stereotyping on these claims
  • Training inequality – the EEOC may deem your training ineffective and insufficient
