Gary P. Segal, Chicago-based member of Dykema’s Corporate Finance Practice Group, has co-authored a chapter in the Thomson Reuters book, Strategic Alternatives For And Against Distressed Businesses, 2018 ed.

Segal’s chapter, titled "Perspectives: Secured Creditors," explores distressed businesses from a secured creditor’s perspective and covers the following areas in depth: 

  • signs of a distressed borrower;
  • due diligence—analyzing the borrower’s problems and financial situation;
  • financial consultants / turnaround professionals;
  • analyzing the loan file and collateral;
  • meeting with the borrower;
  • pre-liquidation / pre litigation actions;
  • methods of liquidation / collection; and
  • lender liability and equitable subordination issues.
