Pushing Back: How Defense Attorneys Beat the DOJ

Moderated by Dykema Member and former U.S. Attorney Leigha Simonton, this panel features the lead defense attorneys who prevailed against the DOJ in three recent federal criminal cases involving alleged healthcare and research-fraud allegations: United States v. Wang (District of Maryland), United States v. Ott (Southern District of Georgia), and United States v. Navarro (Western District of Texas).

First, Jennifer Beidel—former Assistant U.S. Attorney in the Southern District of New York and current Dykema White Collar and Government Investigations attorney—will discuss how diving into discovery and uncovering Brady documents led DOJ Criminal Fraud attorneys to dismiss their indictment against her client, a research scientist.

Second, Stephen Lee—former Assistant U.S. Attorney in the Northern District of Illinois and owner of Stephen Lee Law—will explain how attacking the trial evidence on venue and intent led a federal district judge to grant a motion for judgment of acquittal in a case involving alleged Anti-Kickback Statute violations.

Finally, Tiffany Eggers—former Assistant U.S. Attorney in the Northern District of Florida and Criminal Chief in the Northern District of Texas, and now a Dykema White Collar and Government Investigations attorney—will describe how her laser focus on the government’s statute-of-limitations evidence led the DOJ to dismiss an indictment 71 days after she first met with her client, who was charged with wire and mail fraud related to alleged pass-through medical billing.

This webinar will also highlight the DOJ’s common tactics in healthcare and research-fraud investigations and prosecutions, and feature key winning strategies common to all three cases.
