The article, “Companies May See More Compliance Rules After Kolcraft,” outlines the key provisions of a recent high-profile settlement agreement between the CPSC and Kolcraft Enterprises, Inc. As Laurenza notes, the inclusion of certain compliance provisions in the agreement triggered sharp disagreements among the three CPSC commissioners, as reflected in the commissioners’ follow-up statements.

Laurenza adds that the Kolcraft agreement and the language in the statement of the majority commissioners have generated concern within the business and legal communities as to the CPSC’s future intentions regarding civil penalty settlements with companies that allegedly fail to file timely substantial product hazard reports with the commission.
