Dykema, a leading national law firm, is proud to announce the formation of its dedicated Illinois Biometric Information Privacy Act (BIPA) team. As one of only a few law firms currently defending Illinois companies against BIPA class action suits, Dykema is uniquely situated to handle the anticipated influx in related litigation due to arise as a result of the statute and recent case law developments.

BIPA, currently the only state biometric privacy statute with a private right of action, garnered national attention and class action litigation, with dozens of cases pending alleging violations of the statue. Defendants in these cases typically include employers of all types and businesses that interact with Illinois residents that collect biometric information, such as fingerprints and hand or face scans, including biometric tools to track employee hours and access to restricted areas.

Dykema’s team of attorneys, led by Cinthia Granados Motley, Director of the firm’s Global Data Privacy and Information Security practice group, has a wealth of experience in a variety of facets of data privacy and security risk management and litigation. In addition to its substantial track record of obtaining successful outcomes in defending high stakes class action across the country, the Dykema team includes members from various practice groups including Global Data Privacy and Information Security, Business and Commercial Litigation, and Labor and Employment.

The group has substantial experience defending privacy consumer lawsuits brought against companies and their boards of directors and has successfully defended U.S. and multinational companies in the U.S. abroad against data privacy and protection laws, both in trial and appellate courts. Dykema’s national presence coupled with strategically located firm offices in “hub” jurisdictions, including Illinois—which is becoming the preferred jurisdiction for privacy class action lawsuits makes the BIPA team distinctively positioned to represent organizations both in federal and state courts nationwide.

As part of Dykema’s holistic approach to this emerging area, the firm also offers a robust compliance practice to assist clients as they navigate the often confusing, ambiguous and evolving data privacy and security regulatory landscape.
