David Miracchi is a San Antonio litigation attorney who represents employers in workplace disputes and related litigation. An associate attorney Dykema’s Labor and Employment Practice Group, David draws on appellate and employment litigation experience to help clients analyze complex legal issues, develop practical litigation strategies, and advance their positions through clear and persuasive advocacy.

As part of Dykema’s employment litigation team, David supports corporations, public employers, and other organizations in matters involving discrimination, harassment, retaliation, wrongful discharge, wage and hour disputes, employee leave, employment agreements, restrictive covenants, unfair competition, and trade secrets. He also assists clients with employment counseling and workplace compliance matters. Drawing on his employment litigation and appellate background, David assists throughout the litigation process, from analyzing legal issues and managing discovery to drafting motions and briefs and helping develop trial and appellate strategies.

Before joining Dykema, David served as a staff attorney for the Texas Fourth Court of Appeals in San Antonio, where he worked in Justice Brissette’s chambers. He previously served as an assistant attorney general in the General Litigation Division of the Office of the Texas Attorney General representing state agencies in employment disputes.

David also participated in the U.S. Department of Labor’s Honors Attorney Program, handling appellate matters and drafting briefs, motions, and legal memoranda. His experience with a Texas appellate court, the state attorney general’s office, and the federal agency responsible for administering and enforcing many workplace laws informs his thoughtful and thorough approach to labor and employment litigation.
