In this workshop, Dykema Member Daniel R. Stern will address how to conduct workplace investigations, how to confront and remedy harassment and current topics of interest. The one thing that is clear about employment law claims and issues is that nothing is clear. One method to help clarify rights and obligations when workplace problems are encountered is to conduct a fact-based investigation, which will assist employers in making sound employment decisions. We will review the who, what, where, when, why, and how of workplace investigations, including who should conduct the investigation, what information should be considered, when investigations must be conducted, where these investigations should take place, why conducting a proper and thorough investigation is important, and how to make sure your documents don’t become the employee’s exhibits, by effectively documenting the investigations and related results. 

The program will also include a robust discussion of the challenges and legal obligations faced by employers as a result of the #MeToo and other movements. We will discuss Supreme Court authority that may allow an employee to assert a harassment claim over incidents that happened years before. It is more important now more than ever to have robust grievance and complaint policies so that you know if a problem exists. We will also discuss effective policies, implementation of those policies and effective training techniques. Finally, the program will address how the new tax law impacts the handling of these claims.
