Secured Alternative Writ from Court of Appeal After Client’s Trial Counsel Was Disqualified

When a client’s trial counsel was disqualified by the court three years into the case and one month before trial, Cory prepared a writ petition in less than a week. After issuing an immediate stay and receiving an informal response and a reply, the Court of Appeal granted an alternative writ. The trial court promptly vacated its disqualification ruling. The client then prevailed at trial with the chosen trial counsel at the helm.

Secured Published Opinion in Client’s Discretionary Appeal under the Class Action Fairness Act

After a federal court remanded a putative class action to state court, Cory drafted a petition for the Ninth Circuit to accept a discretionary appeal. The Ninth Circuit granted the petition and, after full merits briefing, issued a published opinion in favor of the client and establishing precedent on how a class action defendant can meet the amount-in-controversy requirement for federal court jurisdiction under the Class Action Fairness Act.
